Wedding Photography Terms & Conditions
The agreement contains the entire understanding between Rachel Noël and the client.
After availability has been confirmed and approved, you will be sent a wedding photography agreement to review and sign. Upon receipt of this agreement and the initial deposit, Rachel Noël Photography will reserve the time and date agreed upon, and will not make other reservations for that time and date. For this reason, the reservation deposit is non-refundable, even if the date is changed or the wedding cancelled for any reason; including acts of God, fire, strike and/or extreme weather. The reservation deposit is to be paid at the time of signing the contract. The reservation deposit is deducted from the total amount of payment due for the wedding photography. Payment is usually staggered into three equal parts. The first third at the point of reservation, the second third mid-way between the agreement and the wedding date, the third and final part is due 4 weeks before the wedding date. Specific dates applicable to your wedding will be supplied in your wedding photography agreement.
In the event that the client cancels the contracted services for wedding photography outlined in their agreement before the wedding ceremony takes place, the deposit(s) will be forfeited. The client may cancel this contract at any time by giving written notice to Rachel Noël Photography, but in doing so shall forfeit any monies paid.
The style of photography will be a natural and more behind the scenes approach, to capture natural moments. If the client desires group posed photos or photos with specific people it is the responsibility of the client to tell the photographer who these people are and the client will be responsible for (or have someone designated for this responsibility) identifying people/objects of whom/which specific photographs are desired. The photographer will not be held accountable for not photographing people who they do not know.
The client understands and accepts that the photographic coverage will be as the photographer’s professional expertise determines. Any special requests not notified on the booking form must be made by the client to Rachel Noël in writing.
The parties agree to positive cooperation and communication for the best possible result. Rachel Noël Photography is not responsible for key individuals’ failure to be present or to cooperate during photography sessions, neither for missed images due to details not revealed to Rachel Noël Photography.
All images provided will be retouched to a quality which is considered to be appropriate by the photographer.
Digital Negatives, Prints and Copyrights
The client will be able to download a digital set of edited images taken. These will be available as a direct download using your personalised login from our 'client area' on the website. Image quantities will vary depending on coverage (in hours), but normally range between 300 - 500 images/day of requested coverage. It is agreed that Rachel Noël Photography retains copyright of all images and may display and use photographs taken for advertising, display and portfolio purposes. Rachel Noël Photography allows the client to store/share/copy/print all images for personal/friends/family use only, subject to no commercial or financial gain.
It should be noted that you are strongly advised to immediately copy/backup your wedding photographs from this download to a suitable computer/storage device. Digital media has a limited lifespan therefore any storage device cannot be guaranteed indefinitely. Also, please note that Rachel Noël Photography are under no obligation to keep copies of your images once received.
Limit of Liability
In the unlikely event of severe medical, natural, or other emergencies, it may be necessary to retain an alternative photographer. Rachel Noël Photography will endeavour to find a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the contracted event.
